(Participation Agreement & Assumption of Risk)

This Participation Agreement (“Agreement”) applies to all Hop In With Toni experiences offered by CCT Trips, a brand of Diversified Coaching LLC. By booking or participating in a Hop In With Toni experience, you acknowledge that you have read, understand, and agree to the terms outlined below.

1. Who We Are

2. Nature of Hop In With Toni Experiences

Hop In With Toni experiences are private, hosted, small-group day trips designed to provide a coordinated and relaxed outing without guests needing to plan, drive, or manage logistics.

Experiences are hosted by Toni Cessna or a designated host.

Hop In With Toni experiences are:

  • Not guided tours

  • Not packaged travel products

  • Not operated by third-party tour operators

They are hosted day experiences organized by CCT Trips.

3. Transportation Acknowledgment

Transportation may be included as part of the hosted experience and may involve:

  • Transportation provided by Toni Cessna

  • Use of a rental vehicle

  • Meeting at designated locations

  • A combination of the above

Transportation is provided as part of a hosted experience and not as a commercial transportation service.

Participants acknowledge that transportation arrangements may involve non-refundable costs and inherent risks.

By participating, guests voluntarily agree to any transportation component and agree to follow all reasonable safety instructions.

4. Assumption of Risk

Participants understand that travel and group activities involve inherent risks, including but not limited to:

  • Vehicle travel

  • Walking on uneven surfaces

  • Weather conditions

  • Physical activity

  • Illness or injury

Participants knowingly and voluntarily assume all risks, whether foreseen or unforeseen, associated with participation.

5. Health, Fitness & Ability to Participate

Participants confirm they are physically and medically able to participate.

Participants are responsible for:

  • Disclosing relevant medical or mobility concerns in advance

  • Bringing necessary medications or assistive devices

  • Monitoring their own comfort and participation

CCT Trips reserves the right to deny or discontinue participation if safety concerns arise.

6. Experience Pricing & Structure

Hop In With Toni experiences are priced as a flat rate per experience, not per person.

Pricing includes participation for up to the maximum number of guests specified at booking.

No refunds or partial refunds are issued if fewer guests attend than the maximum included.

Pricing, inclusions, duration, guest limits, and experience details are governed by the Hop In With Toni Experience Pricing Guide in effect at the time of booking.

7. Additional Charges & Experience Limits

Additional charges may apply, subject to availability and host discretion, including:

  • Additional time beyond scheduled duration (within allowed limits)

  • One additional guest beyond the base guest count

  • Excessive vehicle cleaning due to participant actions

Half-day experiences may not exceed approximately seven (7) total hours.
Full-day experiences may not exceed approximately twelve (12) total hours.
Experiences are limited to a maximum of four (4) guests.

Additional charges are not guaranteed and remain subject to host discretion.

8. Custom Experiences

Custom Hop In With Toni experiences involve additional planning.

  • The planning portion of a custom experience is non-refundable.

  • Any prepaid tickets, reservations, transportation arrangements, or third-party expenses associated with a custom experience are non-refundable.

Remaining balances are governed by the Hop In With Toni Cancellation & Refund Policy.

9. Cancellations & Refunds

All cancellations, rescheduling, credits, non-refundable portions, and no-show policies are governed by the Hop In With Toni Cancellation & Refund Policy, which is incorporated by reference into this Agreement.

Participants acknowledge that certain portions of the experience fee, including transportation-related costs, may be designated as non-refundable as outlined in that policy.

10. Itinerary Flexibility

Hop In With Toni experiences require flexibility.

CCT Trips reserves the right to adjust timing, routing, stops, or activities as needed due to weather, safety considerations, operational needs, or availability.

Such adjustments do not constitute grounds for a refund.

11. Conduct Expectations

Participants agree to behave in a respectful and cooperative manner toward:

  • The host

  • Other participants

  • Businesses and venues visited

Disruptive, unsafe, or inappropriate behavior may result in removal from the experience without refund.

12. Photography & Marketing

CCT Trips may use photographs or video taken during experiences for marketing and promotional purposes.

Participants who prefer not to appear in marketing materials must notify CCT Trips in writing prior to the experience.

Photos taken in public spaces may be used without additional permission unless written notice is provided in advance.

13. Communications & Electronic Signatures

Participants consent to receive communications related to the experience via email, phone, or text message.

Electronic acknowledgments and signatures carry the same legal effect as handwritten signatures.

14. Limitation of Liability

To the fullest extent permitted by law, CCT Trips, Diversified Coaching LLC, and Toni Cessna are not responsible for:

  • Injury, illness, or medical emergencies

  • Accidents or incidents during transportation

  • Lost, stolen, or damaged personal property

  • Delays, changes, or interruptions

  • Weather conditions or acts of God

Participation is voluntary and at the participant’s own risk.

15. Release & Hold Harmless

By participating in a Hop In With Toni experience, participants release, waive, and hold harmless CCT Trips, Diversified Coaching LLC, and Toni Cessna from any claims, demands, actions, or liabilities arising from participation, except in cases of gross negligence or willful misconduct as defined by law.

16. Governing Law

This Agreement is governed by the laws of the State of Ohio, without regard to conflict of law principles.

17. Updates to Terms

CCT Trips reserves the right to update these Terms at any time.

Continued participation or booking after updates constitutes acceptance of the most recent version.

18. Agreement Acknowledgment

By booking or participating in a Hop In With Toni experience, you confirm that:

  • You have read and understand this Participation Agreement

  • You voluntarily agree to its terms

  • You acknowledge the pricing structure, cancellation policy, and inherent risks associated with participation
